Jason M. Burton served as litigation and trial counsel in a premises liability matter prosecuted on behalf of four North Carolina Residents injured in a structural collapse at an apartment complex in Montgomery, Alabama. Our clients had traveled to Alabama for a graduation ceremony and sustained life altering injuries when a second story landing at an apartment complex collapsed and dropped them approximately 12 feet to the ground. Before trial, the apartment complex’s insurance company offered approximately $7,000,000 to settle the cases. After a five-week trial, the jury returned combined compensatory damages verdicts of $24,500,000 and a punitive damage verdict of $250,000. We were able to secure a $3,200,000 settlement as the trial date approached.

Description: Jason M. Burton served as litigation counsel for an elderly Alabama citizen who was injured in a structural collapse at an apartment complex in Montgomery, Alabama. Our client sustained a crush fracture to her calcaneus (heel bone) and required a complicated re-constructive surgery. After fully investigating the case and taking testimony from the orthopedic surgeon that performed the surgery, we were able to reach a $1,150,000 settlement.

Description: Jason M. Burton and Burton Law Firm, PLLC served as counsel for a Union County, North Carolina minor, who sustained serious injuries as a result of a cinder block building collapse on a rural rental property. We also served as counsel for the minor’s Mother. Our investigation revealed that the structure in question was dilapidated, poorly constructed and lacked concrete reinforcement typically found in similar construction applications. After providing summary opinions from our client’s engineering and property management experts, and a copy of a draft Complaint, we were able to resolve the case for $1,001,000, which represented all collectable insurance proceeds available to the property owners.

Description: Jason M. Burton and Burton Law Firm, PLLC served as counsel for a Johnston County, North Carolina motorcyclist that was injured when a motorist failed to yield on a flashing yellow light and made a left turn in front of him. We were retained shortly after the accident occurred and assisted the at-fault driver’s insurance company in making a liability determination by presenting a signed statement from the only eye-witness to the accident. Less than four months after the accident, we were able to resolve the case for $1,000,000, which represented all insurance proceeds available under the commercial policy insuring the at-fault driver.

Description: Jason Michael Burton and Burton Law Firm served as counsel for a Wake Forest, North Carolina man who sustained second and third degree flame burns in a structural fire at a local nursing home. Through a forensic electrical inspection, it was determined that our client’s room was misconfigured by the nursing home, which contributed to the injuries our client suffered in the fire. Our client survived for several weeks in intensive medical care before passing away as a result of his injuries. Shortly after our client’s death, we were able to resolve the wrongful death claim for $1,000,000, which represented all collectable insurance proceeds available to the nursing home.

Description: Jason M. Burton and Burton Law Firm, PLLC were retained to represent several Martinsville, Virginia residents who were injured by an intoxicated driver that traveled left of center on U.S. 158 in Stokesdale, North Carolina at approximately 6:30 a.m. on Sunday, October 30, 2016. Both vehicles were overturned as a result of the collision and all individuals on the scene of the accident were transported to local area hospitals. Our client’s injuries ranged from a single visit to the emergency room, to significant fractures and complicated surgeries. The at-fault driver had only $100,000 in insurance coverage but we were able to secure recoveries under nine additional insurance policies to ensure that our clients were fully compensated for their injuries. The cases ultimately settled for an amount in excess of $725,000.

Description: Jason M. Burton served as counsel in a North Carolina Wrongful Death claim prosecuted on behalf of the surviving spouse and child of a Granville County school teacher stuck and killed by a drunk driver that crossed left of center. Our client was a literacy coach in the Granville County Public School System and was traveling to an area school at approximately 11:00 a.m. on a Tuesday morning when a drunk driver struck her head on. After fully investigating the matter, we were able to make recoveries under three separate insurance policies and settle the claim for all available insurance coverage.

Description: Jason M. Burton and Burton Law Firm, PLLC served as litigation and trial counsel in a personal injury case filed on behalf of a young lady that sustained facial lacerations, facial fractures, and a traumatic brain injury in an accident with a semi-truck performing a turn around maneuver on a two lane highway in the middle of the night. Prior to trial, the insurance company offered our client $150,000 to settle her case. We rejected the offer and tried her case in front of a jury, who awarded $500,000 in damages. With prejudgment interest and recoverable costs, the judgment exceeded $561,000.

Description: Jason Michael Burton and Burton Law firm were retained to represent a Charlotte, North Carolina man who was injured in an airplane crash while vacationing in California. Shortly after departing the runway for a sightseeing tour, there was an interruption in fuel supply, which caused the WWII era aircraft to lose engine power and crash land on the runway below. The flight operator attempted to avoid liability by arguing that our client had waived any potential claims against it in contractual disclaimers signed before boarding the flight. Prior to filing the lawsuit, the flight operator offered our client $25,000 to settle his claim. After filing a lawsuit in California, and conducting a forensic investigation of the airplane, we were able to obtain maintenance records showing a long history of problems with the airplane’s fuel line and component parts. The case was settled during discovery for $250,000, which represented all collectable insurance proceeds.

Description: Jason M. Burton and Burton Law Firm, PLLC were retained to represent a Randolph County, North Carolina man who suffered a broken wrist and lumbar spine fracture in a fall from a rooftop in Maputo, Mozambique. The travel insurance policy purchased before the trip provided medical evacuation coverage but the insurer misrepresented the amount of available coverage and failed to timely evacuate our client back to the United States. We asserted claims against the travel insurance company for bad faith denial of insurance benefits and were able to secure a $200,000 settlement even though our client had less than $9,000 in actual damages.

Description: Jason M. Burton and Burton Law Firm, PLLC were retained to represent a Wisconsin couple that was injured by a vehicle transport truck while traveling on Highway 26 in Hendersonville, North Carolina. Our investigation revealed that the transport truck driver lost control of his vehicle and pinned and dragged our clients approximately 400 feet against a concrete bridge abutment. Our clients sustained soft tissue injuries and suffered from post traumatic stress disorder as a result of the accident. The transport truck’s insurance company ultimately agreed to settle the case for $140,000.

Description: Jason Michael Burton and Burton Law Firm were retained to represent a Raleigh, North Carolina man who was struck by an intoxicated driver in the parking lot of his apartment complex. The client, who sustained a broken wrist and bruises and abrasions about his body, had been turned away by a number of other personal injury law firms that were unwilling to pursue his case. After investigating the claim, we were able to settle the claim for $100,000, which represented all proceeds available under the auto liability policy issued to the at-fault driver and all proceeds available under our client’s underinsured motorist policy.

Description: Jason M. Burton and Burton Law Firm, PLLC were retained to represent a young lady that sustained injuries to her neck, back, and shoulder when she was struck by the driver of a plumbing truck that crossed left-of-center in a high speed police chase. Through our investigation of the case, we learned that the plumbing company employed the driver even though he had more than 15 criminal or traffic related offenses in the five years before the accident. The claim was asserted against the driver of the truck and the plumbing company that employed the at-fault driver. In addition to securing a substantial monetary recovery, our efforts in the case helped reform the plumbing company policies and ensure that drivers are properly investigated before being hired and given keys to the company vehicles.

Description: Jason Michael Burton and Burton Law Firm served as counsel for a Fayetteville, North Carolina man that was injured when a Bladen County Sheriff’s Deputy ran a red light at approximately 70 miles per hour and collided into the vehicle being driven by our client. The Plaintiff suffered an open head laceration and was life-flighted for emergency medical treatment. After the North Carolina Highway Patrol assigned fault to the deputy, the Bladen County Sheriff’s Office denied liability and attempted to blame our client for causing the accident. Through our investigation, we were able to establish that the Sheriff’s Office disregarded official procedures and had either lost or destroyed internal documents related to the accident. At mediation, the Defendants agreed to settle the case for $97,500, an amount that was sufficient to compensate our client for his injuries, medical bills, and pain and suffering.

Description: Jason M. Burton and Burton Law Firm, PLLC was retained to pursue a North Carolina Worker’s Compensation Claim on behalf of a middle-aged over-the-road truck driver who sustained an on-the-job shoulder injury while operating a pallet jack. We assisted our client through a complicated surgery and reached a substantial settlement that accounted for our client’s injuries and on-going wage impairment.

Description: Burton Law Firm, PLLC and Jason M. Burton served as counsel on behalf of an elderly Indiana resident who suffered a broken elbow when she slipped and fell on a dangerous condition in the parking lot of a national hotel chain in Durham, North Carolina. The insurance company for the hotel initially denied liability asserting that our client was at fault in failing to recognize the dangerous condition of the sidewalk. Through our investigation, we were able to uncover evidence showing that an employee had fallen in the same location and reported the fall to hotel management but hotel management failed to address or correct the dangerous condition. Through our efforts, the insurance company ultimately agreed to settle the case for $85,000.

Description: Jason M. Burton and Burton Law Firm, PLLC served as counsel for a man that was struck from behind while operating a moped in Raleigh, North Carolina. Our investigation revealed that the teenage at-fault driver was engaged in distracted driving when she collided with the rear end of our client’s moped and ejected him to the ground. We were able to secure a $65,000 settlement on our client’s behalf.

Burton and Burton Law Firm, PLLC served as counsel in an uninsured motorist claim pursued on behalf of a middle aged motorcyclist that was struck and injured by a hit-and-run driver who fled the scene and was never apprehended. Our client spent weeks in the hospital as a result of a broken ankle and complicated surgery. Even though the other driver was never located, we were able to obtain a recovery under the client’s uninsured motorist coverage and settlement the claim for the insurance policy limits.
